1. Agreement

Use of this Website is subject to acceptance of the following Terms of Use.

1. Price and Payment

1.1 The Price that Customers have to pay will be shown on the order page of our payment system provider or on the invoice sent following an email or phone enquiry.

1.2 Payment shall be made either online via Paypal or credit card, or offline, via wire transfer when the order is placed on the phone or via email.

1.3 Invoices are due and payable upon ordering.

1.4 Price reflected on our website may change without notice.

1.5 Price of AKARALI products on third party websites linked to the main AKARALI website (www.akarali.com) may change based on promotions, foreign exchange rates and other commercial considerations.

2. Delivery

2.1 The delivery date specified in the Order Confirmation is an estimate. The place of delivery is as stated in the Order Confirmation.

2.2 Any missing, wrong or damaged Products or packaging should be noted on the waybill prior to signing it.

2.3 Shall the parcel be returned because an error/incorrect address on the buyer’s end, reshipping might incur extra shipping charges.

2.4 AKARALI deserves the rights to change the vendor to undertake the delivery of its products and services without notice.

2.5  Delivery is understaken and fulfilled by third party services such as DHL, FEDEX and other logistics providers that are determined by AKARALI.

3. Responsibilities

3.1 All sales are processed and shipped by Akarali from Malaysia or subsidiary in other countries and the ownership of the product belongs to the buyer after the product is purchased.

3.2 All products purchased on Akarali’s website are subject to Malaysian Law.

3.3 In rare cases, purchased products may be subject to import duties and taxes which will be levied when it reach the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

3.4 You must comply with all applicable laws and regulations of the country into which you import our products. We will not be liable for any breach by you of any such laws.

4. Returns

4.1 If you are not 100% satisfied with your purchase, you can either return your order for a full refund or exchange it for something else. You can return or exchange your purchase for up to 20 days from the purchase date. Returned or exchanged products must be in the condition you received them and in the original box and/or packaging.

4.2 Products should be checked upon receipt. Replacement for damaged goods will be considered provided immediate notification (within 24 hours) is made to Akarali.

5. Customer Responsibility and Waiver of Consent

By accepting these Conditions, I affirm as if under oath and state truthfully that:

5.1 I am 18 years of age or an adult with the legal capacity to enter into binding agreements of sale with Akarali

5.2 I am permitted by law to receive purchased products from Akarali in my current locale

5.3 I will promptly contact my local physician for any necessary medical intervention should a complication or concern result related to the use of the products.

5.4 I understand that use of this website is completely voluntary and initiated by me. I understand that all products purchased cannot be returned or refunded.

6. Data Protection (or Privacy)

Personal Customer data obtained by Akarali shall be held and processed in accordance with all applicable laws and consistent with Akarali’s Privacy Policy.

7. Governing Law, Jurisdiction, Severability and Notices

7.1 Malaysian law is applicable and both parties agree to submit to the exclusive jurisdiction of the Malaysia courts.

7.2 ALL INFORMATION, PRODUCTS AND SERVICES PROVIDED ON THIS WEBSITE ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. BY MY USE OF THIS WEB SITE, I ACKNOWLEDGE THAT SUCH USE IS AT MY SOLE RISK. I ALSO AGREE THAT THE AGGREGATE LIABILITY OF AKARALI ARISING FROM OR RELATED TO MY USE AND ACCESS, REGARDLESS OF THE FORM OF ACTION OR CLAIM (FOR EXAMPLE, CONTRACT, WARRANTY, TORT, NEGLIGENCE, STRICT LIABILITY, PROFESSIONAL MALPRACTICE, FRAUD, OR OTHER BASES FOR CLAIMS), IS LIMITED TO THE PURCHASE PRICE OF ANY ITEMS YOU PURCHASED FROM AKARALI IN THE APPLICABLE TRANSACTION. AKARALI SHALL NOT IN ANY CASE BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES EVEN IF AKARALI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL LOSSES AND DAMAGES OF ANY KIND. IF YOU ARE DISSATISFIED WITH OUR WEB SITE OR ITS CONTENT (INCLUDING TERMS OF USE), YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING OUR WEB SITE. I UNDERSTAND AND AGREE THAT AKARALI IS NOT RESPONSIBLE FOR THE INTENTIONAL OR NEGLIGENT ACTS OR OMISSIONS OF ANY HEALTH CARE PROVIDER, SUCH AS THE PRESCRIBING PHYSICIAN OR PHARMACY, TO WHICH AKARALI MAY CONNECT ME.

8. Content sharing & Usage of Logo

8.1  AKARALI™ is a registered trademark (Serial Number #88418549) with the United States Patent and Trademark Office (USPTO), the Intellectual Property Corporation of Malaysia (MyIPO) and in several other countries.

8.2  Any content (eg: images, video) that displays the AKARALI logo or brand from the AKARALI.com website or any third party sites (including social media platforms such as Facebook, Twitter) can be shared by the users on other digital and online platforms.

8.3  AKARALI™ brand, or logo cannot be used, displayed, reproduced or marketed as a product or services by any party without a written permission. Any usage of the AKARALI logo without a written permission or consent by the brand owner may result in a legal action.

8.4  AKARALI™ brand or trademark logo is permitted by the USPTO to be used in products under the category of Health food supplements; Herbal supplements for boosting energy; Herbal teas for medicinal purposes; Nutritional supplements; Plant extracts for pharmaceutical purposes; Digestives for pharmaceutical purposes; Medicinal herbal extracts for medical purposes and Medicinal herbal preparations.

9. Changes to the agreement

This agreement is subject to change – at the sole discretion of AKARALI or the brand owner at any time, without notice.
